The account of case results is to illustrate the experience of the firm in a variety of litigation areas. Each case is unique, and the results in one case do not necessarily indicate the value of another case.
Clients, a mother and her small child were traveling in their minivan on Orlando Ave. While turning left across an intersection into a private school in Maitland, a commercial truck ran the red light and struck the passenger side of the minivan. The minivan was a total loss. The mother suffered injuries to her shoulder and upper back. The son received several minor facial scars. On the eve of filing suit against the driver and his employer, the insurance company settled for $125,000.00.
Husband and wife clients were rear ended in their vehicle by negligent driver. Both husband and wife received injuries to their back. We initially settled with negligent driver's insurance company for policy limits of $20,000.00. Then, we sought additional recovery against the clients' Uninsured/Underinsured Motorist portion of their insurance policy. In lieu of filing a lawsuit, we recovered an additional $32,000.00 from the stacked policy limits of $40,000.00 for clients.
Client, a graduate student in Engineering, while unloading groceries from his mother's car, was approached by non-uniformned, armed city police officer who asked if he was an individual they were looking for. He stated he was not and refused to provide officers identification because they refused to provide their badges and left the scene. Officers subsequently performed an armed felony stop on client at the bus station where he went to pick up his friend. Client was arrested for resisting an officer without violence and spent one day in jail. Charges were not filed by the State Attorney. Our firm filed a Notice of Claim with the city alleging federal civil rights violations, false arrest, and false imprisonnment. City settled prior to filing suit for $20,000.
Client ordered an entree at a local Olive Garden Restaurant specifically requesting that an ingredient be withheld because the client was severely allergic. The entree was still served with the ingredient and the client had a severe allergic reaction and spending a night in the hospital but suffering no permanent injury. After a demand letter was sent, we settled with Olive Garden for $9,000.00.
Client was rear ended by commercial tow-truck and received injury to her back. After client was released from doctor's treatment, we filed a demand for settlement with the tow truck company's insurance company. Using a unique online mediation service, we obtained a settlement of $23,750.00.
Client was rear-ended by negligent driver. Client received injury to his back. The spinal disc injury required corrective surgery. Before incurring the expense of filing suit, we settled with the negligent driver's insurance company for $100,000.00.
Client was shopping at Kmart when she slipped on water that had leaked from a flower pot display. Client suffered a Sacroiliac Sprain/Strain and Coccygodynia. Alleging negligence and premises liability we settled, pre-suit, with Kmart for $14,000.
Client, a minor, was vacationing with his family at a local resort when he slipped and fell on a walkway near the resort pool. Client suffered a laceration on the back of his head that required several stiches and resulted in a permanent scar. We settled with the resort's insurance company for $13,500.
Client stopped at gas station to use restroom. Client entered the single men's restroom which was occupied by female deputy who became upset and belligerent. Client went back to vehicle and drove away. Female deputy followed client and performed a traffic stop. Client was arrested for DUI and spent one day in jail. Breath Alcohol Test revealed no alcohol in system and urine sample revealed no presence of drugs. Our firm filed a Notice of Claim with the OCSO alleging federal civil rights violations, false arrest, and false imprisonnment. Sheriff's Office settled prior to filing suit for $12,750.
City entered into a purchase agreement with Client for client's software. Client received half of the contract amount to start. Client spent 8 months installing and modifying program at City's request. City then decided it did not want the program and refused to pay. Our firm filed suit for Breach of Contract. After almost two years of litigation, City agreed to settle the case.
